Sheinbaum Sets High Bar for Extradition of Sinaloa Governor: ‘Overwhelming Evidence’ Required

Reflecto News | U.S.-Mexico Relations | Security & Justice

MEXICO CITY — Mexican President Claudia Sheinbaum has firmly responded to U.S. extradition requests for Sinaloa Governor Rubén Rocha Moya and nine other officials, declaring that her government will not proceed without “overwhelming evidence” and warning against foreign interference in Mexico’s sovereign affairs .

The U.S. Department of Justice unsealed an indictment on Wednesday charging Rocha and the other current and former Mexican officials with conspiring with the Sinaloa Cartel to import massive quantities of narcotics into the United States in exchange for political support and bribes .

🛡️ ‘We Will Not Protect Anyone, But Evidence Must Be Clear’

Speaking at her regular morning press conference on Thursday, President Sheinbaum struck a careful balance between asserting Mexico’s sovereignty and pledging not to shield the accused from justice if sufficient proof exists .

“We are not going to protect anyone who has committed a crime. However, if there isn’t clear evidence, it is obvious that the objective of these indictments by the Department of Justice is political.”
President Claudia Sheinbaum, Mexico

The Mexican government has stated that extradition documents received from the U.S. Embassy “do not include the elements of proof” necessary under Mexican law to justify the requests . Mexico’s Foreign Ministry noted that the requests would be sent to the Attorney General’s Office for evaluation .

The U.S. charges are particularly sensitive because Rocha is a member of Sheinbaum’s own Morena party and a staunch ally of her predecessor, former President Andrés Manuel López Obrador .

📜 The Indictment: U.S. Allegations Against Rocha and Others

According to the unsealed indictment, the 10 defendants allegedly conspired with the Sinaloa Cartel—designated a terrorist organization by the U.S.—to import fentanyl, heroin, cocaine, and methamphetamine into the United States .

Key allegations include:

  • Political protection: Defendants allegedly used their positions to shield cartel operations
  • Bribery: Political support and campaign contributions were exchanged for cartel favors
  • Los Chapitos faction: The group is accused of aligning with the faction of the cartel run by the sons of Joaquín “El Chapo” Guzmán, who is serving a life sentence in a U.S. prison

The charges include narcotics importation conspiracy and possession of machine guns and destructive devices .

Governor Rocha has “categorically and completely” rejected the accusations, calling them baseless slander and an “attack” on Mexico’s ruling party .

“Its is part of a perverse strategy to violate [Mexico’s] constitutional order, specifically on national sovereignty,” he wrote on X .

⚖️ The Legal Process in Mexico

President Sheinbaum explained that Mexico’s Attorney General’s Office (FGR) had received the extradition requests on Tuesday night and would analyze them in accordance with Mexican law .

Key procedural points:

  • The FGR will determine whether sufficient evidence exists to justify provisional arrest orders
  • Mexico has also initiated a parallel investigation into the allegations
  • Sheinbaum emphasized that Mexico’s Foreign Ministry issued a formal complaint about the U.S. leak of the documents to the press, as such processes should remain confidential under international treaties

Sheinbaum affirmed that Mexico will not permit foreign governments to interfere in decisions that “fall exclusively within Mexicans’ jurisdiction” .

“Under no terms would Mexico permit interference of a foreign government in its sovereign affairs.”
President Claudia Sheinbaum

🛩️ A Rare Indictment with Major Diplomatic Implications

The DoJ’s charges against Rocha—a sitting state governor—represent an extraordinary escalation in the U.S. war against cartels . While the U.S. has repeatedly indicted drug kingpins, charges against senior Mexican politicians are extremely rare .

The case now places Sheinbaum in a difficult position: cooperate with the Trump administration by extraditing a governor from her own party, or risk further straining bilateral relations by protecting him .

The Mexican government has stressed that it will act based on “truth, justice, and defense of sovereignty,” leaving the final decision to the Attorney General’s Office .
